SUPPLIER CODE OF CONDUCT

OUR COMMITMENT

HOIANA includes Vietnam’s largest casino managed by Suncity Group, a world-class 18-hole golf course and a range of luxurious suites and guestrooms managed by the Rosewood Hotel Group.

HOIANA is committed to the highest standards of ethical conduct, social and environmental responsibility. We endeavor to minimize environmental impact through reduction of energy usage and water, the re-use and recycling of resources consumed, development and integration of sustainable technologies as well as sustainable procurement and supply chain practices.

EXPECTATIONS OF OUR SUPPLIERS

HOIANA believes that a strong and ethical relationship with its suppliers is key to ensuring its success. Our relationship with suppliers must be founded on the following core values and principles, which we expect our suppliers to be in full compliance with the followings when conducting business with, for, or on behalf of HOIANA.

(i) HOIANA’s Supplier Code of Conduct sets out the minimum standards which includes but is not limited to Labor and Human Rights, Health and Safety, Environmental Protection, Corruption and Bribery, Anti-Money Laundering and Responsible Sourcing.

(ii) all applicable laws, codes, and regulations.

1. LABOR AND HUMAN RIGHTS

Discrimination

  • Suppliers shall not discriminate against any employees on the basis of race, color, nationality, sex, gender identity, age, sexual orientation, religion, social or ethnic origin, political opinion, disability, marital status, pregnancy, or other similar factors in hiring, terms and conditions, or other employment practices.
  • Suppliers shall treat their employees with respect and dignity and ensure they are protected from harassment, discrimination and other forms of abuse including physical, mental, sexual or verbal.

Child Labor

  • Suppliers shall not employ any employee under the local legal minimum age for employment.
  • Suppliers shall maintain complete and accurate age documentation records verifying the age of all employees.

Wages, Benefits and Hours

  • Suppliers shall comply with all laws and regulations governing minimum wages, maximum hours of work, pay rates, overtime pay and other elements of compensation.
  • Suppliers shall ensure wages are paid in a timely manner directly to the employees which include all legally mandated benefits.
  • Employees should not be required to pay or reimburse any recruitment fees, nor shall suppliers deduct such recruitment fees from any employee’s compensation, except if it is under the statutory requirements.
  • Suppliers shall keep complete and accurate records of their employees for validation of wages, benefits and time worked.

Human Trafficking

  • Suppliers shall ensure that all work is voluntary. There should not be any forced, involuntary labor or coerced labor.
  • Suppliers shall not engage in or allow any form of human trafficking, whether by force, fraud or coercion, or any form of involuntary slavery or sex trafficking.
  • Every employee should have the freedom of movement. The ability of employees to move freely should not be restricted by their employer through abuse, threats and practices such as unlawful retention of passports and valuable possessions.

2. WORKPLACE HEALTH AND SAFETY

Work Environment

  • Suppliers shall provide their employees with a safe, secure and healthy work environment in compliance with all applicable laws and regulations related to workplace conditions.
  • Suppliers shall ensure that the workplace facilities should have reasonable access to clean bathrooms and potable water. Facilities must also be well-ventilated with adequate lighting and must have passed all required safety inspections.
  • Suppliers shall continue to maintain all required health and safety permits, licenses, and certificates for the workplace building.

Occupational Health, Safety and Hazard Prevention

  • Suppliers shall identify, evaluate and manage occupational health and safety hazards and shall provide employees with appropriate training related to health and safety hazards to ensure their awareness.
  • Depending on the job risk exposure, suppliers shall provide their employees with the appropriate personal protective equipment and instructions on its proper use.
  • Suppliers shall proactively identify the causes and mitigate harm associated with occupational health and safety hazards. These include but are not limited to ensuring facilities are not overcrowded, passageways are not blocked, fire hazards are minimized, and equipment is regularly maintained to ensure good working conditions.
  • Suppliers shall take measures to protect their employees from exposure to and infection with any diseases and viruses. Suppliers should adopt infection prevention and control strategies based on a thorough workplace hazard assessment, safe work practices, and personal protective equipment to prevent employees from the risk of infection.

Employees’ Rights

  • Suppliers shall respect and recognize the rights of each employee to freedom of association and communicate openly with management regarding unfair working conditions or treatments without threat of penalty, harassment, abuse, discrimination or bullying.
  • Suppliers shall grant their employees the rights to associate freely, freedom to join labor unions, seek representation and join employees’ councils and engage in collective bargaining.
  • Suppliers shall establish a grievance mechanism channel that allows their employees to lodge grievances or provide any feedback or suggestions. Suppliers shall ensure all communications from their employees are kept confidential without retaliation.

3. ENVIRONMENTAL PROTECTION

  • Suppliers shall comply with all applicable environmental laws and regulations.
  • Suppliers shall ensure their activities are conducted in an environmentally responsible manner, including meeting all legal requirements for environment, water and air emissions, pollution controls, chemical and waste management.
  • Suppliers shall preserve, protect and reduce environmental impact by undertaking initiatives to promote greater environmental responsibility, considering sustainable technologies to reduce the use of energy and water and re-using or recycling resources.
  • Suppliers shall ensure proper disposal of wastewater, waste chemicals, and solid waste. All records related to hazardous waste disposal must be properly maintained and monitored.

4. CORRUPTION AND BRIBERY

  • Suppliers shall conduct themselves with high standards of honesty, integrity and accountability and shall at all times comply with anti-bribery laws and regulations.
  • Suppliers shall in no circumstances engage in any form of corruption or bribery. This includes directly or indirectly giving or receiving any gift, payment or other form of benefit which is, or maybe construed as being a bribe.

5. ANTI-MONEY LAUNDERING

  • Suppliers shall strictly comply with all applicable anti-money laundering laws and regulations.
  • Suppliers shall not engage or attempt to engage in any transaction involving proceeds derived from unlawful activity.
  • Suppliers shall immediately report to HOIANA any matter suspected to be related to money laundering or terrorist financing.

6. CONFLICT OF INTEREST

  • Suppliers shall avoid any actual, potential, or perceived conflicts of interest. They must avoid any relationship, business, financial or otherwise which may compromise the performance or activities related to the services provided to HOIANA.
  • Supplier shall declare to HOIANA immediately any potential conflicts of interest as soon the case arises.

7. RESPONSIBLE SOURCING POLICY

The Responsible Sourcing Policy applies to all purchases of raw materials including food and beverages, hotel supplies and amenities, disposables, and packaging materials.

Suppliers are expected to continuously increase their sourcing of raw materials and packaging materials to more sustainable and eco-friendly materials whenever feasible and engage in a continuous improvement process to verify their processes and practices against the Responsible Sourcing Policy.

The Responsible Sourcing Policy comprises of the following key principles and it shall form an integral part of the supplier’s pre-qualification and evaluation process in which the outcome of the assessment will be critical in deciding the continuation of business relationships with HOIANA.

Sustainability Compliance

  • Suppliers shall ensure that all materials and products supplied to HOIANA are in compliance with the Responsible Sourcing Policy and they must meet the quality and safety standards required by the applicable law, standards and regulations.
  • Suppliers shall ensure transparency of material flows throughout their entire value chain to ensure products are produced in a responsible way.
  • Suppliers shall demonstrate strong product safety and quality management practices.

Environmental Sustainability

  • Suppliers shall continually strive to minimize the amount of waste generated and energy consumed to minimize the environmental impacts.
  • In addition, suppliers must:
    (i) implement programs to re-use or recycle materials from their manufacturing process whenever practical.
    (ii) develop technologies to reduce the use of energy and water such as the use of renewable energy.

Communities and Society

  • Suppliers will actively seek opportunities to source locally and support the local communities in their sourcing and procurement processes whenever feasible.
  • Suppliers are encouraged to provide benefits to society by supporting, volunteering or participating in community social work whenever deemed appropriate.

Animal Welfare and Illegal Wildlife Trade

  • HOIANA encourages its suppliers to implement humane procedures to prevent the mistreatment of animals at all times, including when they are raised, cared for, transported, and processed. In addition, all employees must be trained inhumane handling of animals and their welfare to ensure awareness of and compliance with this policy.
  • Suppliers shall ensure that their staff at slaughterhouses must establish a set of procedures in place such that the animals are slaughtered with minimum pain or distress at the time of killing.
  • Illegal wildlife trade is often unsustainable, harming wild populations of animals and plants and pushing endangered species toward extinction. HOIANA will not hesitate to terminate the business relationship with suppliers if they are suspected or involved in any illegal and unsustainable wildlife trading.

Marine Animals and Aquaculture

  • Suppliers shall ensure that they will not supply any marine species that are critically endangered or listed under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
  • Suppliers shall not acquire seafood from an illegal source or Marine Protected Area, or capture the marine animals using highly destructive fishing methods.

Sustainable Forestry

  • HOIANA encourages its suppliers to use paper products that are made of recycled materials or paper products that are certified by the Forest Stewardship Council (FSC) or other legitimate certifying bodies on sustainable forestry.

Biodiversity Management

  • Suppliers shall minimize the use of agrochemicals and pesticides in their agriculture. They must ensure that only legally registered pesticides are used for the sole need to control weeds, diseases and pests.

8. LEGAL COMPLIANCE

  • Suppliers shall conduct their business in compliance with applicable fair competition and anti-trust laws.
    • Suppliers shall ensure full compliance with this Supplier Code of Conduct. Failure to comply with any provision in this Supplier Code of Conduct could result in termination of the business and/or contractual business relationship with HOIANA.

9. MONITORING AND EVALUATION

  • HOIANA is committed to working closely with its suppliers to ensure full compliance with the Supplier Code of Conduct. HOIANA may elect to conduct assessments into the supplier’s practices to ensure ongoing compliance.
  • Suppliers shall allow HOIANA, its designated agents, auditors and third-party representatives to access their facilities for evaluation of compliance with the Supplier Code of Conduct. Suppliers shall fully cooperate with HOIANA to produce all required documentation that may be needed to demonstrate compliance with the Supplier Code of Conduct.

10. REPORTING CONCERNS OR VIOLATIONS

HOIANA has established a confidential reporting line named ‘Speak Up’. Suppliers can report any concerns, violations or suspected violations of applicable laws, regulations, and this Supplier Code of Conduct through our ‘Speak Up’ channels below:

11. REVIEW AND UPDATES

This Supplier Code of Conduct may be amended by HOIANA from time to time and the updated version will be made available on the HOIANA website.
